This study investigates how one important accounting professional authority—CPA Canada—discusses accounting ethics and exhorts its members to think about ethics-related issues. To do this, we rely on empirical evidence of the types of arguments used by CPA Canada to describe what they consider acceptable moral justifications in a variety of practical situations that accountants may encounter. We argue that the articles contained in the profession’s primary publication for all members, CPA Magazine, offer a wealth of such evidence. We analyze 237 (...) articles about accounting ethics that were published in CPA Magazine from January 2000 to December 2017, and find evidence of moral pluralism. Six categories of justifications dominate: private commitments, utility, perfectionist ends, general duties, and specific obligations, plus self-interest. Of these categories, the specific obligations logic is the most widely used. We offer a tentative explanation, and discuss the implications of our findings for a better grasp of the complexities of accountants’ practical conflicts and a rethink of the ongoing tension between professionalism and commercialism. In this study, we investigated the relationships between judgments of intentionality and moral evaluation in individuals with High Functioning Autism (HFA) or Asperger Syndrome (AS). HFA or AS are neurodevelopmental disorders characterised by severe deficits in communication and social functioning. Impairments in Theory of Mind (ToM), i.e., the ability to attribute mental states to oneself and to others, are thought to be the core features of autism. Of all mental states, the concept of ‘intentional action’ is particularly important. People normally (...) distinguish between actions that are performed intentionally and those that are performed unintentionally and this distinction plays a crucial role in social understanding and moral judgment. Recently, Knobe (Analysis 63: 190–193, 2003a ), (Philosophical Psychology 16: 309–324, 2003b ) showed that people’s moral evaluations might serve as input to the process by which people intuitively arrive at the intentionality judgments. Here, by using two pairs of vignettes, the Knobe’s Harm/Help cases and Murder/Bull’s-eye cases, we showed that, as already observed in typical population, in individuals with HFA/AS judgment of intentional action is informed by the moral appreciation of the action outcome. However, the two groups differed on praise judgments and moral justifications, suggesting that these processes were poorly influenced by the agent’s psychological states. We concluded that, although under certain circumstances, individuals with HFA/AS and people with typical development have similar intuitive judgments of intentionality, over-assignment of praise judgments and the reduced use of folk-psychological concepts in moral judgment likely reflect difficulties using intentionality information for moral reasoning. It has become commonplace to say that with the advent of technologies like synthetic biology the line between artifacts and living organisms, policed by metaphysicians since antiquity, is beginning to blur. But that line began to blur 10,000 years ago when plants and animals were first domesticated; and has been thoroughly blurred at least since agriculture became the dominant human subsistence pattern many millennia ago. Synthetic biology is ultimately only a late and unexceptional offshoot of this prehistoric development. From this (...) perspective, then, synthetic biology is a red herring, distracting us from more thorough philosophical consideration of the most truly revolutionary human practice—agriculture. In the first section of this paper I will make this case with regard to ontology, arguing that synthetic biology crosses no ontological lines that were not crossed already in the Neolithic. In the second section I will construct a parallel case with regard to cognition, arguing that synthetic biology as biological engineering represents no cognitive advance over what was required for domestication and the new agricultural subsistence pattern it grounds. In the final section I will make the case with regard to human existence, arguing that synthetic biology, even if wildly successful, is not in a position to cause significant existential change in what it is to be human over and above the massive existential change caused by the transition to agriculture. I conclude that a longer historical perspective casts new light on some important issues in philosophy of technology and environmental philosophy. (shrink)

Many commentators agree that Wittgenstein took the idea that propositions are Bilder, or at least the terminology of Bilder, from Heinrich Hertz, or from Hertz and Ludwig Boltzmann. Boltzmann, the great Viennese theoretical physicist, was the founder of statistical thermodynamics, the modern theory of heat. The context within which Hertz and Boltzmann worked was one in which many prominent theoretical physicists accepted the Kantian restriction that our thought cannot access 'things in themselves', but works only with representations. Wittgenstein may have (...) found what Hertz said attractive, but even if he did develop a theory of representation or a picture theory of meaning, neither was something that he just took over from Hertz, fully formed, and his main concerns were puzzles about intentionality, not science. Hertz and Boltzmann did influence various aspects of the Tractatus. Their greatest and most lasting influence on Wittgenstein, though, was on his conception of philosophy itself: its aim, and its method. (shrink)

A revised core curriculum for medical ethics and law in UK medical schools has been published. The General Medical Council requires medical graduates to understand law and ethics and behave in accordance with ethical and legal principles. A parallel policy agenda emphasises accountability, the development of professionalism and patient safety. Given the renewed focus on teaching and learning law alongside medical ethics and the development of professional identity, this survey aimed to identify how medical schools are responding to the preparation (...) of medical students for practice in the future. Questions were asked about the location, content and methods of teaching and assessment of law in undergraduate medical education. Examples of course documentation were requested to illustrate the approaches being taken. A 76% response rate was achieved. Most responding schools integrate law teaching with medical ethics, emphasising both the acquisition of knowledge and its application in a clinical context. Teaching, learning and assessment of law in clinical attachments is much less formalised than that in non-clinical education. Coverage of recommended topic areas varies, raising questions about the degree to which students can embed their knowledge and skills in actual practice. More positively, teaching does not rely on single individuals and clear descriptions were offered for problem-based and small group case-based learning. Further research is required to explore whether there are optimum ways of ensuring that legal knowledge, and skills in its use, form part of the development of professionalism among doctors in training. In this short paper we analyse some paradoxical aspects of France’s Foucauldian heritage: while several French scholars claim the COVID-19 pandemic is a perfect example of what Foucault called biopolitics, popular reaction instead suggests a biopolitical failure on the part of the government; One of these failures concerns the government’s inability to produce reliable biostatistical data, especially regarding health inequalities in relation to COVID-19. We interrogate whether Foucaldianism contributed, in the past as well today, towards a certain myopia in France (...) regarding biostatistics and its relation to social inequalities in health. One might ask whether this very data could provide an appropriate response to the Foucauldian question: What kind of governance of life is the pandemic revealing to us? (shrink)

The ability to distinguish between our own actions and those of an external agent is a fundamental component of normal human social interaction. Both low- and high-level mechanisms are thought to contribute to the sense of movement agency, but the contribution of each is yet to be fully understood. By applying small and incremental perturbations to realistic visual feedback of the limb, the influence of high-level action intentions and low-level motor predictive mechanisms were dissociated in two experiments. In the first, (...) participants were induced to claim agency over movements that were subject to large perturbations and to deny agency over self-produced unperturbed movements despite the application of motor corrections by low-level mechanisms. A control experiment confirmed that if reaches met with their intended goal then they were more likely to be attributed to the agent, regardless of the discrepancy between the actual and seen positions of the limb. The growing presence of the products of nanotechnology in the public domain raises a number of ethical questions. This paper considers whether existing environmental ethics can provide some guidance on these questions. After a brief discussion of the appropriateness of an environmental ethics framework for the task at hand, the paper identifies a representative environmental ethic and uses it to evaluate four salient issues that emerge from nanotechnology. The discussion is intended both to give an initial theoretical take on nanotechnology (...) from the perspective of environmental ethics and to provide a clear indication of the direction from which environmental resistance might come. Der kürzlich verstorbene US-amerikanische Soziologe Robert K. Merton war der prominenteste und einflußreichste Anomie-Theoretiker nach Emile Durkheim. Seine Typologie der Arten individueller Anpassung an anomische gesellschaftliche Situationen bietet heute noch eine wertvolle Grundlage zur Analyse von Gesellschaften. Dieser Beitrag konzentriert sich auf einen dieser Anpassungstypen, den Ritualismus, der Merton zufolge beinhaltet, daß einerseits die kulturellen Ziele, allen voran das des wirtschaftlichen Wohlstands, heruntergeschraubt oder aufgegeben und andererseits die institutionellen Normen zur Erreichung dieser Ziele beinahe zwanghaft befolgt werden. Diese Definition überdenkend (...) versucht der vorliegende Beitrag herauszuarbeiten, daß innerhalb des Systems der Anpassungsformen das Herunterschrauben der kulturellen Ziele nicht das Hauptcharakteristikum ritualistischen, sondern konformen Verhaltens darstellt. Ritualisten haben den Prozeß des Herunterschraubens vielmehr bereits beendet, indem sie jegliche kulturellen Ziele aufgegeben haben, bis auf den einen Wert an sich, nämlich die institutionellen Regeln einzuhalten.Ritualistische Anpassung ist aus Merton`s Sicht für die Soziologie abweichenden Verhaltens, ganz zu schweigen von den Kriminalwissenschaften, nicht von Interesse. Im Gegensatz zu dieser Einschätzung versucht dieser Artikel die verschiedenen soziologischen und sogar kriminologischen Implikationen ritualistischen Verhaltens darzustellen, mit dem Ergebnis, daß Ritualismus sehr wohl ein soziales Problem darstellt. Der Ritualist unterwirft sich nicht nur selbst den institutionellen Normen, sondern fühlt sich auch dazu berufen, andere ständig an die Einhaltung der Regeln zu gemahnen und sie zu überwachen. Deshalb gibt es viele typisch ritualistische Formen abweichenden Verhaltens, wie Denunziation, erzieherischer Tadel oder Mobbing, die sogar in kriminelles Verhalten wie falsche Verdächtigung, Nötigung oder Beleidigung kulminieren können.Am schillerndsten ist die Rolle des Ritualisten in der Kriminalpolitik, nicht zuletzt heute in der Bundesrepublik. Repression jeglicher Art ist seine Antwort auf Regelverstöße und die Kriminalpolitik macht zunehmend Zugeständnisse an ritualistische Forderungen nach härterer und schnellerer Bestrafung oder umfassender Überwachung des öffentlichen Raumes. Ritualisten dominieren den sozialen Diskurs und die allgemeine Wahrnehmung von Kriminalität nicht nur, weil sie wichtige Nutzer und damit Zielgruppe gewisser Massenmedien sind und gerne Leserbriefe schreiben. Sie sind so dominant, weil ihre Art der Anpassung bei zunehmender wirtschaftlicher Krise die Konformität der Wirtschaftswunderzeit zurückgedrängt hat und heute die am weitesten verbreitete in der deutschen Gesellschaft ist. Daher ist auch die schon seit Jahrzehnten zu beobachtende Verschiebung der theoretischen Strafzweckbegründung hin zur Positiven Generalprävention alles andere als ein Zufall. The recently deceased US-sociologist Robert K. Merton has been the most prominent and influential anomie theorist since Emile Durkheim. His typology of modes of adaptation to anomic social situations still constitutes a valuable basis for analyzing society. This contribution focuses on one of these types of adaptation, ritualism, which according to Merton, involves the scaling down or abandoning of the cultural goals, above all economic wealth, on the one hand and to abide almost compulsively by institutional norms to attain these goals on the other. In reconsidering this definition, this contribution attempts to elaborate that within the system of adaptive modes scaling down does not describe the main characteristic of ritualistic behaviour, but first of all characterizes conformity. Ritualists, on the contrary, have already completed the process of scaling down by finally abandoning any cultural goal except the one end-in-itself, that is to comply with the institutional rules.Ritualistic adaptation, in Merton`s view, is of no interest to the sociology of deviant behaviour, not to mention criminal sciences. In contrast to this evaluation this contribution tries to delineate the various sociological and even criminological implications of ritualistic behaviour, leading to the conclusion that Ritualism does indeed present a social problem. The ritualist does not only surrender himself to the institutional means but feels competent to constantly reminding others of abiding by the institutional norms and supervising them. Hence there are many typically ritualistic forms of deviant behaviour like denunciation, disciplinary reproof or mobbing that may even culminate in criminal behaviour like false suspicion, duress or insult.Most ambiguous is the ritualist`s part in criminal policy, not at least in contemporary Germany. Repression of any kind is his answer to breaches of the rules and criminal policy more and more concedes to ritualistic demands for more severe and rapid punishment or extensive supervision of public facilities. Ritualists dominate the social discourse and general perception of criminality, not only because they are important users and therefore the target group of certain mass media, and like to write letters to the editor. They do dominate because in times of increasing economic crisis their mode of adaptation has forced back the conformity of the German economic miracle era and is now the most common one in contemporary German society. Thus, the shift in the theoretical justification of punishment towards a theory of positive general prevention, noticeable for decades, is anything but accidental. (shrink)

Medical councils increasingly require graduates to understand law and to practise medicine mindful of the legal rules. In the UK a revised curriculum for medical law and ethics has been published. However, coverage of law in medical education remains variable and doubts exist about how far students acquire legal knowledge and skills in its implementation. This survey of students in two UK medical schools measured their law learning and their confidence in using this knowledge. Concept maps and a self-audit questionnaire (...) were used to capture students' understanding and perceptions of this knowledge domain and self-assessments of their legal knowledge and skills. A large sample was achieved across first, second and final year students. Students agree that a sound understanding of law is essential to being a good doctor. Their perceptions of law are generally positive but the interface between the legal rules and codes of medical ethics creates difficulty. In some areas students offer relatively confident self-assessments of their legal knowledge and skills for practising law. However, levels of confidence in other areas of their law learning raise doubts about the degree to which they can advocate for and protect their patients. Conclusions are drawn about the effectiveness of students' law learning and recommendations made for further research. (shrink)

New technologies create new complexities. Since non-invasive prenatal tests (NIPTs) were first introduced, keeping pace with complexity constitutes an ongoing task for medical societies, politics, and practice. NIPTs analyse the chromosomes of the fetus from a small blood sample. Initially, NIPTs were targeted at detecting trisomy 21 (Down syndrome): meanwhile there are sequencing techniques capable of analysing the entire genome of the unborn child. These yield findings of unclear relevance for the child’s future life, resulting in new responsibility structures and (...) dilemmas for the parents-to-be.The industry’s marketing strategies overemphasize the benefits of the tests while disregarding their consequences. This paper chooses the opposite path: starting with the underestimated consequences, it focuses on adverse developments and downsides. Disparities, paradoxes, and risks associated with NIPTs are illustrated, ethical conflicts described. Indications that new technologies developed to solve problems create new ones are examined. In the sense of critical thinking, seemingly robust knowledge is scrutinized for uncertainties and ambiguities. It analyses how the interplay between genetic knowledge and social discourse results in new dimensions of responsibility not only for parents-to-be, but also for decision-makers, authorities, and professional societies, illustrated by a review of different national policies and implementation programmes. As shown by the new NIPT policy in Norway, the consequences can be startling. Finally, a lawsuit in the United States illustrates how an agency can risk forfeiting its legitimation in connection with the inaccuracy of NIPTs. (shrink)

This chapter surveys the respective influences of Personalism and of analytic philosophy on twentieth-century thought about persons. It shows that personalism promoted a concept of personhood that is supportive of human dignity and conducive to positive moral and social engagement, as exemplified in Personalism’s best-known representative, Martin Luther King, Jr. By contrast, the analytic tradition has exhibited a persistent tendency to undermine personhood as King and the Personalists understood it, while failing to supply a metaphysically and morally adequate alternative. This (...) unfortunate legacy is worth reversing if possible. With this in mind, I suggest that contemporary analytic philosophy has something important to learn from personalism concerning what counts as an adequate metaphysical basis for human dignity and the moral life. I write this article as a postgraduate researcher undertaking a doctorate in Education, with an interest in research as a transformative process, and fascinated by the debate as to whether reality is objective or subjective. In reflecting on this, I recalled a significant incident that occurred when I was Professional Education Lead in an NHS hospital. I had been asked to work with a nurse, who had been disciplined as a consequence of talking about her Christian faith with a patient. (...) The nurse was assuming that, in sharing experiences that were transformative for her, she might also transform the patient’s perception of her own illness and its meaning. As a Christian myself, I was caught in a situation where I could understand the conflicting perspectives of all key players, including the patient, her family, the nurse, and the NHS managers. I explore how I mediated my way through this situation, aiming to do justice to all perspectives, and the ethical dilemmas I faced when having to choose between personal and professional values. As a consequence of this incident, I have learned that, not only is transformation a deeply personal experience, but because it is either influenced by, or leads to, a specific world view, it supports the idea of reality being subjective rather than objective. A great deal has been made of the question of whether nano-materials provide a unique set of ethical challenges. Equally important is the question of whether they provide a unique set of regulatory challenges. In the last 18 months, the US Environmental Protection Agency has begun the process of trying to meet the regulatory challenge of nano using the Toxic Substances Control Act (1976)(TSCA). In this central piece of legislation, ‘newness’ is a critical concept. Current EPA policy, we argue, does (...) not adequately (or ethically) deal with the novelty of nano. This paper is an exploration of how to do a better job of accounting for nanomaterials as ‘new.’ We explore three alternative ways that nanomaterials might be made to fall under the TSCA regulatory umbrella. Since nanomaterials are of interest precisely because of the exciting new properties that emerge at the nano-scale, each of these three alternatives must meet what we call the ‘novelty condition’ and avoid what we call the ‘central paradox’ of existing regulatory policy. Failure to meet either of these conditions is a moral failure. We examine both the strengths and weaknesses of each alternative in order to illuminate the conceptual, practical, and moral challenges of novelty. (shrink)

This paper draws on the experience of one research project in action to evaluate the usefulness of research ethics frameworks when the environment surrounding project negotiation, data collection and dissemination is seriously disturbed by critical incidents. The paper questions the lack of emphasis in research ethics codes on the competence and capacity of agencies when commissioning and sponsoring research. Using events that surrounded one project, the paper researches the research. It explores what impacted on the creation of the context for (...) ethical and effective research and how the researchers responded to the ethical challenges that emerged. Different theoretical understandings and ethical models are drawn upon to explore how a research team translated ethical research in theory into ethical research in practice within an organization in turmoil. Identifications, diagnoses, and treatments of pseudo-problems form a family of classic methodologies in later nineteenth century philosophy and at least partly, as I shall argue, in the philosophy of science. They were devised, not by academic philosophers, but by three of the greatest of the philosopher-scientists. (Later, the idea was taken up by academic philosophers, of course. But I will not discuss that development). Here I show how Ernst Mach, Heinrich Hertz and Ludwig Boltzmann each deployed methods of this general (...) kind, how they identified different pseudo-problems, how they gave different diagnoses of such problems, and how they suggested quite different treatments for them. I argue that it was Mach who really first developed the idea of a pseudo-problem, that he did so in a relatively focused way on the basis of two kinds of examples. Hertz’s contribution was much more limited, identifying two specific pseudo-problems concerning physics, and suggesting a way in which they might be treated. Boltzmann’s conception of pseudo-problems, though, was far less focused, being applied to a very wide range of problems in philosophy and physics. However, his conception was certainly more influential in philosophy, and perhaps ultimately more fruitful and suggestive. I argue for the originality and continuing interest of such approaches, and I try to dissociate them from any problematic ‘positivism’. (shrink)

Sustainable technology is a microcosm that illuminates the relationship between technology and human agency. We tend to think about sustainability in terms of the properties of things. However, technology is not just things but techniques which have their own bearing on sustainability, for users may employ sustainable technologies in unsustainable ways. Clueless or stymied users may be managed through education or redesign; however, there are intractable users who cannot be managed through either approach. I trace the cause of this intractability (...) to interaction between the improvisational nature of human agency and the multiple realizability of artifact functions. I argue that managing intractable users requires going with the flow of their relationship to technology rather than trying to control it through education or redesign, and that democratizing the development and distribution of technology is the best way to do this. Finally, these results easily generalize to technologies not aimed at sustainability. (shrink)

This thesis examines how association football evolved in Liverpool in the period before the Great War, and how the sport impacted on the lives of Liverpudlians during this period. Specific consideration is given in the first two chapters to the introduction of football to Liverpool and its progressive commercialisation. The third chapter examines the backgrounds of the city's professional footballers and their relationship with supporters and clubs. The role in Liverpool of amateur, semi-professional, and schoolboy football is considered in the (...) fourth chapter. Identities form a common theme of the final chapters, which examine the local culture of football supporters and newspapers' relationship with the game. The study uses a wide range of primary and secondary sources, including some previously unconsidered evidence. It is argued that previous interpretations of the sport's introduction are misleading and that football actually originated as a Muscular Christian initiative by Cambridge educated clergy at the end of the 1870s. Despite this comparatively late introduction, political and business interests influenced football, and in Liverpool the sport underwent an intense process of commercialisation. Profit seems to have been a priority for the original Everton FC and its positive commercial prognosis led to the club's selection as a founder member of the Football League. The scale of importation of professional footballers by Everton and Liverpool football clubs was to the detriment of local talent, although the city's amateur game was thriving by the 1900s. Though football was immensely popular in Liverpool, the city's unusual social and economic demography meant that a significant proportion of its population were unable to attend professional matches, or to make a significant contribution to the amateur game. From the 1900s, attendances in Liverpool grew more slowly as major football clubs in other cities attracted more spectators. (shrink)

Cet article s’inscrit dans le cadre d’une recherche doctorale portant sur les représentations de la séparation chez des enfants placés en Protection de l’enfance. Il s’intéresse ici spécifiquement au dessin de la famille de deux enfants d’âge de latence placés en foyer. L’article analyse chaque dessin en profondeur puis tente de dégager les éléments saillants communs aux enfants rencontrés, tout en les mettant en lien avec les mouvements transféro-contretransférentiels à l’œuvre dans ces rencontres-séparations. Ces dessins montrent de grandes difficultés de (...) représentation, les personnes dessinées sont peu différenciées. Cette indistinction pourrait être mise en lien avec le concept de mentalisation qui aurait été mis à mal par les traumatismes vécus par ces enfants. Mais ce trouble de la mentalisation semble aussi fonctionner comme un mécanisme de défense contre les reviviscences traumatiques et des mouvements pulsionnels agressifs. (shrink)

The place of Heinrich Hertz’s The principles of mechanics in the history of the philosophy of science is disputed. Here I critically assess positivist interpretations, concluding that they are inadequate.There is a group of commentators who seek to align Hertz with positivism, or with specific positivists such as Ernst Mach, who were enormously influential at the time. Max Jammer is prominent among this group, the most recent member of which is Joseph Kockelmans. I begin by discussing what Hertz and Mach (...) had to say about one another, and I specify certain respects in which their views are indeed similar. I then go on to detail their differences, looking at Hertz’s attitude to the atomic theory, to the mechanical world-view, to simplicity, to unobservables and metaphysics, and his objections to Newtonian forces. This volume contains thirteen papers that were presented at the 2017 Annual Meeting of the Canadian Society for History and Philosophy of Mathematics/Société canadienne d’histoire et de philosophie des mathématiques, which was held at Ryerson University in Toronto. It showcases rigorously reviewed modern scholarship on an interesting variety of topics in the history and philosophy of mathematics from Ancient Greece to the twentieth century. A series of chapters all set in the eighteenth century consider topics such as John Marsh’s techniques (...) for the computation of decimal fractions, Euler’s efforts to compute the surface area of scalene cones, a little-known work by John Playfair on the practical aspects of mathematics, and Monge’s use of descriptive geometry. After a brief stop in the nineteenth century to consider the culture of research mathematics in 1860s Prussia, the book moves into the twentieth century with an examination of the historical context within which the Axiom of Choice was developed and a paper discussing Anatoly Vlasov’s adaptation of the Boltzmann equation to ionized gases. I hope to demonstrate that the papers which Feyerabend wrote between 1955 and the mid-1960's can most profitably be understood as a contribution to this project. The first three chapters lay the groundwork of Feyerabend's (...) earlier epistemology. They pick out the themes in his model for the acquisition of 'knowledge'. Chapter One sets out Feyerabend's rather unorthodox conception of scientific or theoretical realism, which has not received the attention which I believe it deserves. I detail Feyerabend's objections to some anti-realist positions and outline the formidable structure of his central argument for realism. The scope of issues of justice extends globally on many issues. Governance of global society therefore needs transformed institutions. A vision of global democracy assumes a relational model of self‐determination as non‐domination in the context of inclusive and stronger global institutions.
